Institutional guidelines for transgender children and adolescent minors fail to adequately address a critical juncture of care of this population: how to proceed if a minor and their parents have disagreements concerning their gender-affirming medical care. Through arguments based on ethical, paediatric, adolescent and transgender health research, we illustrate ethical dilemmas that may arise in treating transgender and gender diverse youth. We discuss three potential avenues for providing gender-affirming care over parental disagreement: legal carve-outs to parental consent, the mature minor (...) doctrine and state intervention for neglect. Our discussion approaches this parent–child disagreement in a manner that prioritises the developing autonomy of transgender youth in the decision-making process surrounding medically assisted gender affirmation. We base our arguments in the literature surrounding the risks and benefits of gender-affirming therapy in transgender children and the existing legal basis for recognising minors’ decision-making authority in certain medical situations. Current epistemological orthodoxy has it that knowledge is incompatible with luck. More precisely: Knowledge is incompatible with epistemic luck . This is often treated as a truism which is not even in need of argumentative support. In this paper, I argue that there is lucky knowledge. In the first part, I use an intuitive and not very developed notion of luck to show that there are cases of knowledge which are “lucky” in that sense. In the second part, I look (...) at philosophical conceptions of luck and come to the conclusion that knowledge can be lucky in those senses, too. I also turns out that a probabilistic notion of luck can help us see in what ways a particular piece of knowledge or belief can be lucky or not lucky. (shrink)

This article discusses an interpretation of Kant's conception of transcendental subjectivity, which manages to avoid many of the concerns that have been raised by analytic interpreters over this doctrine. It is an interpretation put forward by selected C19 and early C20 neo-Kantian writers. The article starts out by offering a neo-Kantian interpretation of the object as something that is constituted by the categories and that serves as a standard of truth within a theory of judgment. The second part explicates transcendental (...) subjectivity as the system of categories, which is self-referential and constitutes objects, in order to then evaluate this conception by means of a comparison with Hegel's absolute subject. Rather than delineating the differences between neo-Kantian writers, the article systematically expounds a shared project, which consists in providing the ultimate foundation for judgments by means of an anti-psychologist and non-metaphysical interpretation of transcendental subjectivity. Most recent accounts of personal autonomy acknowledge that the social environment a person lives in, and the personal relationships she entertains, have some impact on her autonomy. Two kinds of conceptualizing social conditions are traditionally distinguished in this regard: Causally relational accounts hold that certain relationships and social environments play a causal role for the development and on-going exercise of autonomy. Constitutively relational accounts, by contrast, claim that autonomy is at least partly constituted by a person’s social environment or standing. (...) The central aim of this paper is to raise the question how causally and constitutively relational approaches relate to the fact that we exercise our autonomy over time. I argue that once the temporal scope of autonomy is opened up, we need not only to think differently about the social dimension of autonomy. We also need to reconsider the very distinction between causally and constitutively relational accounts, because it is itself a synchronic (and not a diachronic) distinction. (shrink)

Multinational corporations are operating in complex business environments. They are confronted with contradictory institutional demands that often represent mutually incompatible expectations of various audiences. Managing these demands poses new organizational challenges for the corporation. Conducting an empirical case study at the sportswear manufacturer Puma, we explore how multinational corporations respond to institutional complexity and what legitimacy strategies they employ to maintain their license to operate. We draw on the literature on institutional theory, contingency theory, and organizational paradoxes. The results of (...) our qualitative longitudinal study show that managing corporate legitimacy is a dynamic process in which corporations adapt organizational capacities, structures, and procedures. There is a sceptical puzzle according to which knowledge appears to license an unacceptable kind of dogmatism. Here is a version of the corresponding sceptical argument: (1) If a subject S knows a proposition p, then it is OK for S to ignore all evidence against p as misleading; (2) It is never OK for any subject to ignore any evidence against their beliefs as misleading; (3) Hence, nobody knows anything.I distinguish between different versions of the puzzle (mainly a ‘permissibility’ (...) version and a ‘closure’ version) and offer a solution for one version (the permissibility version) of the problem. No matter how much a subject knows, knowledge never gives one a license to ignore evidence against a proposition. Premise (1) of the argument is false and the puzzle can thus be resolved. (shrink)

Is knowledge necessary or sufficient or both necessary and sufficient for acceptable practical reasoning and rational action? Several authors (e.g., Williamson, Hawthorne, and Stanley) have recently argued that the answer to these questions is positive. In this paper I present several objections against this view (both in its basic form as well in more developed forms). I also offer a sketch of an alternative view: What matters for the acceptability of practical reasoning in at least many cases (and in all (...) the cases discussed by the defenders of a strong link between knowledge and practical reasoning) is not so much knowledge but expected utility. This paper discusses two versions of reliabilism: modal and probabilistic reliabilism. Modal reliabilism faces the problem of the missing closeness metric for possible worlds while probalistic reliabilism faces the problem of the relevant reference class. Despite the severity of these problems, reliabilism is still very plausible (also for independent reasons). I propose to stick with reliabilism, propose a contextualist (or, alternatively, harmlessly relativist) solution to the above problems and suggest that probabilistic reliabilism has the advantage over modal reliabilism.

In a recent work, we introduced a theoretical model for fulfillment in life that covers cognitive and affective components and distinguishes different time frames. The present study evaluates this model and describes the construction of the Fulfilled Life Scale to assess fulfillment regarding the whole lived life retrospectively. We investigated the scale in two samples. The model of the cognitive component combines three sources of fulfillment with three criteria, yielding nine facets. Employing hierarchical factor analysis, we inspected all solutions between (...) one and nine. We identified three optimal factors, which we labeled unfolded self and life, the worthwhile life, and positive impact and legacy. Next, we selected marker items and replicated the factor structure in Sample 2. The three scales were positively intercorrelated and showed good internal consistency in both samples. For the affective component, exploratory and confirmatory factor analyses established a one-factor structure in both samples, and high internal consistency was obtained. Across a range of related constructs, we demonstrated construct and criterion validity. Notably, cognitive and affective fulfillment incrementally predicted a global rating of a fulfilled life and mental well-being, even after controlling for subjective and eudaimonic well-being. Overall, the study proves that the FLS is necessary to capture people’s experience of a fulfilled life, which could not be assessed sufficiently with previous well-being measures. Both cognitive and affective fulfillment were able to predict additional variance in mental well-being. Moreover, the study reveals psychometric support for the FLS and presents the first evidence on its validity. Lastly, applications in research and practice are discussed, especially in the context of living and aging well in the second half of life. (shrink)

ObjectiveIn this study we used functional magnetic resonance imaging to investigate whether motor imagery of handwriting and circle drawing activates a similar handwriting network as writing and drawing itself.MethodsEighteen healthy right-handed participants wrote the German word “Wellen” and drew continuously circles in a sitting and lying position to capture kinematic handwriting parameters such as velocity, pressure and regularity of hand movements. Afterward, they performed the same tasks during fMRI in a MI and an executed condition.ResultsThe kinematic analysis revealed a general (...) correlation of handwriting parameters during sitting and lying except of pen pressure during drawing. Writing compared to imagined writing was accompanied by an increased activity of the ipsilateral cerebellum and the contralateral sensorimotor cortex. Executed compared to imagined drawing revealed elevated activity of a fronto–parieto-temporal network. By contrasting writing and drawing directly, executed writing induced an enhanced activation of the left somatosensory and premotor area. The comparison of the MI of these tasks revealed a higher involvement of occipital activation during imagined writing.ConclusionThe kinematic results pointed to a high comparability of writing in a vertical and horizontal position. Overall, we observed highly overlapping cortical activity except of a higher involvement of motor control areas during motor execution. The sparse difference between writing and drawing can be explained by highly automatized writing in healthy individuals. (shrink)

There are many ordinary propositions we think we know. Almost every ordinary proposition entails some "lottery proposition" which we think we do not know but to which we assign a high probability of being true (for instance: “I will never be a multi-millionaire” entails “I will not win this lottery”). How is this possible - given that some closure principle is true? This problem, also known as “the Lottery puzzle”, has recently provoked a lot of discussion. In this paper I (...) discuss one of the most promising answers to the problem: Stewart Cohen’s contextualist solution which is based on ideas about the salience of chances of error. After presenting some objections to it I sketch an alternative solution which is still contextualist in spirit. (shrink)

This paper argues that the wants or desires of a person can be consistent with each other and still necessarily incompatible with each other and for interesting reasons. It is argued here that this problem is not rare and that there is no solution in sight.

ABSTRACTDoes knowledge entail belief? This paper argues that the answer depends on how one interprets ‘belief’. There are two different notions of belief: belief as such and belief for knowledge. They often differ in their degrees of conviction such that one but not both might be present in a particular case. The core of the paper is dedicated to a defense of this overlooked distinction. The beginning of the paper presents the distinction. It then presents two cases which are supposed (...) to back up the claim that there is an important distinction here; I also offer some explanations concerning the structure of these cases. Finally, I add further considerations in support of the core thesis, and discuss objections. The distinction is important as such but also has interesting implications concerning the much discussed ‘entailment thesis’ according to which knowledge entails belief. It is argued here that even if knowledge entails belief-for-knowledge, it does not entail belief-as-such. This constitutes an interesting middle position and compromise in the philosophical debate about the entailment thesis. One further implication of this paper is that the discussion about the entailment thesis needs to take degrees of conviction seriously. Still another implication is that epistemic contextualists can deal very well with the relevant phenomena. (shrink)

In this paper I respond to P.D. Magnus’ critique of an earlier paper of mine on Thomas Reid’s theory of common sense. In the earlier paper (The Scottish Pragmatist? The Dilemma of Common Sense and the Pragmatist Way Out, Reid Studies 2, 1999, 47-57) I argued that Reid faces a dilemma between dogmatism and scepticism but that there are also hints in his work towards a pragmatist way out of the problem. P.D. Magnus, in a response to this paper (Reid’s (...) Dilemma and the Uses of Pragmatism, Journal of Scottish Philosophy 2, 2004, 69-72), criticizes me for misidentifying the kind of pragmatism one can find in Reid. In this paper I defend my interpretation of Reid and spell the relevant kind of pragmatism out in more detail. (shrink)

In his recent book Moral Skepticisms Walter Sinnott-Armstrong argues in great detail for contrastivism with respect to justified moral belief and moral knowledge. I raise three questions concerning this view. First, how would Sinnott-Armstrong account for constraints on admissible contrast classes? Secondly, how would he deal with notorious problems concerning relevant reference classes? Finally, how can he account for basic features of moral agency? It turns out that the last problem is the most serious one for his account.

Theodore Sider has argued that while there are some philosophical debates about which there is no fact of the matter, debates in normative ethics are likely not among them. This essay investigates a possible counterexample: the debate about so-called dirty hands. The essay first surveys several cases where No-Fact-of-the-Matter (NFM) claims have been made. Taking its cue from these cases, it then outlines two strategies that factualists about some domain can take, as well as two non-factualist counter strategies. Next, it (...) shows how an NFM claim can be defended for the debate about dirty hands. Finally, it argues that this NFM claim is at least as, if not more, plausible for normative ethics as it is for the other instances where NFM claims have been made. (shrink)

According to a widely held view, rationality demands that the preferences of a person be transitive. The transitivity assumption is an axiom in standard theories of rational choice. It is also prima facie very plausible. I argue here that transitivity is not a necessary condition of rationality; it is a constraint only in some cases. The argument presented here is based on the non-linearity of differential utility functions. This paper has four parts. First, I present an argument against the transitivity (...) assumption (I, II). Second, I discuss some objections; this will also bring out some features of the view defended here, like the essentially comparative nature of choice (III). Then, I discuss certain proposals that promise to avoid my conclusion (IV). Finally, I go into some implications concerning the nature of rational decision making (V). To accept some intransitivities as rational does not make our life easier; it can even lead to hard choices. However, it does not lead to skepticism about rational choice. (shrink)

The development of new theory is often spurred by novel techniques that provide better answers to existing questions, or that allow asking new ones. In the field of strategy and organization science, models of complex adaptive systems have renewed theoretical work on a fundamental question: how organizations can adapt effectively to their environments. This article has three objectives: to highlight some areas where models of organizations as complex adaptive systems have made substantial contributions: the search for solutions to sets of (...) interdependent choices, the challenge of balancing processes of exploration and exploitation, and the organization of imperfect decision makers; to point to several challenges and tradeoffs which can limit the explanatory power and eventual impact of the modeling enterprise; and to sketch out possible future directions of research that would do further justice to the notion of organizations as complex adaptive systems. The possibility of knowledge attributions across contexts (where attributor and subject find themselves in different epistemic contexts) can create serious problems for certain views of knowledge. Amongst such views is subject—sensitive invariantism—the view that knowledge is determined not only by epistemic factors (belief, truth, evidence, etc.) but also by non—epistemic factors (practical interests, etc.). I argue that subject—sensitive invariantism either runs into a contradiction or has to make very implausible assumptions. Saving as many lives as possible while ensuring equity for vulnerable groups through access to triage resources has been the dominant position since the onset of the COVID-19 pandemic in 2020. However, the exact relationship between the principles of social justice and efficiency remains a controversial and unresolved issue. In this paper, we aim to systematically distinguish between different models of this relationship and show that conceptualizing social justice as a ‘moral side-constraint’ or adopting a ‘balancing approach’ that attempt to (...) reconcile social justice with efficiency inevitably lead to significant moral costs that require further justification. Based on this discussion, we propose a novel “threshold model” for trading-off moral costs. According to this model, the structural impact of triage must be considered in order to determine whether one opts for triage with the primary aim of efficiency or social justice. This contextualization further explains why, in some societies and circumstances, social justice can rightly be seen as the primary concern, while in other societies and circumstances, efficiency can be defended as the primary concern. Human dignity seems very important to us. At the same time, the concept ‘human dignity’ is extrordinarily elusive. A good way to approach the questions “What is it?” and “Why is it important?” is to raise another question first: In virtue of what do human beings have dignity? Speciesism - the idea that human beings have a particular dignity because they are humans - does not seem very convincing. A better answer says that human beings have dignity because and insofar (...) as they are persons. I discuss several versions of this idea as well as several objections against it. The most promising line of analysis says that human beings cannot survive psychologically without a very basic form of recognition and respect by others. The idea that humans have a very special dignity is the idea that they owe each other this kind of respect. All this also suggests that human dignity is inherently social. Non-social beings do not have dignity - nor do they lack it. It is because we are social animals of a certain kind that we have dignity - not so much because we are rational animals. (shrink)

Based on the findings of a qualitative empirical study of corporate social responsibility (CSR) in Swiss MNCs and SMEs, we suggest that smaller firms are not necessarily less advanced in organizing CSR than large firms. Results according to theoretically derived assessment frameworks illustrate the actual implementation status of CSR in organizational practices. We propose that small firms possess several organizational characteristics that are favorable for promoting the internal implementation of CSR-related practices in core business functions, but constrain external communication and (...) reporting about CSR. In contrast, large firms possess several characteristics that are favorable for promoting external communication and reporting about CSR, but at the same time constrain internal implementation. We sketch a theoretical explanation of these differences in organizing CSR in MNCs and SMEs based on the relationship between firm size and relative organizational costs. (shrink)

The many-worlds view is one of the most discussed “interpretations” of quantum mechanics. As is well known, this view has some very controversial and much discussed aspects. This paper focuses on one particular problem arising from the combination of quantum mechanics with Special Relativity. It turns out that the ontology of the many-worlds view – the account of what there is and what branches of the universe exist – is relative to inertial frames. If one wants to avoid relativizing ontology, (...) one has to argue either that there is an additional source of branching due to Special Relativity and thus additional branches or worlds. Or one has to argue that there are not only many worlds but also many universes ; there is thus not only one tree of many world-branches but many frame-specific trees, a “forest” of many world-trees. Philip Kitcher recently argued for a reconstruction in philosophy. According to him, the contemporary mainstream of philosophy has deteriorated into something that is of relevance only to a few specialists who communicate with each other in a language nobody else understands. Kitcher proposes to reconstruct philosophy along two axes: a knowledge axis and a value axis. The present article discusses Kitcher's diagnosis as well as his proposal of a therapy. This brief paper argues that Kripke’s thesis of the necessity of origin has some implausible consequences.

In this paper, I introduce a new challenge to moral realism: the skeptical argument from moral underdetermination. The challenge arises as a consequence of two recent projects in normative ethics. Both Parfit and a group called consequentializers have independently claimed that the main traditions of normative theories can agree on the set of correct particular deontic verdicts. Nonetheless, as Dietrich and List :421–479, 2017) and myself :191–221, 2018; Australas J Philos 97:511–527, 2019; Ethical Theory Moral Pract 24:999–1018, 2021a) have argued, (...) the traditions still disagree about why these are the correct verdicts. This means that we can understand the situation in terms of an idea from the philosophy of science, the underdetermination of theory by the evidence. Yet underdetermination figures in one of the most important skeptical challenges to scientific realism. I show how an analogous skeptical argument can be construed for the moral realm. I propose a standard form for that argument. I then defend it against three possible objections, arguing that it is at least as plausible as, if not more plausible than, its counterpart in the philosophy of science. (shrink)

This paper argues that three plausible principles are mutually inconsistent: One ought to assert only what one knows; If it is proper to assert some proposition q, then it is, barring special and not very common circumstances, proper to assert any proposition p from which q has been competently inferred; and Some propositions are both properly assertible and known by competent inference from propositions which one does not know. The concept of human dignity has remained surprisingly absent from philosophical discussions about the ethics of childhood so far. Likewise, children as a group are mostly neglected in the ongoing discourse on human dignity. In this paper, we attempt to close this double gap by showing that there is, first, a meaningful way to speak of children’s dignity, and that, second, considering children as a group can be illuminating for dignity theorists in general. After an analysis of the reasons why (...) the debates on human dignity and the ethics of childhood have been conducted almost entirely separately, we develop a concept of respecting children as respecting their dignity. Drawing upon personhood accounts of human dignity, we suggest that respecting a child’s dignity means respecting her activity, which means essentially developing and maintaining a perspective of one’s own. Construed in that way, respecting children’s dignity is in some important respects different from concerns about their well-being and their autonomy. In the last section, we will take a step back from the debate about the ethics of childhood and point to some possible conclusions for the debate about human dignity in general. (shrink)

Inspired by the success of generative linguistics and transformational grammar, proponents of the linguistic analogy (LA) in moral psychology hypothesize that careful attention to folk-moral judgments is likely to reveal a small set of implicit rules and structures responsible for the ubiquitous and apparently unbounded capacity for making moral judgments. As a theoretical hypothesis, LA thus requires a rich description of the computational structures that underlie mature moral judgments, an account of the acquisition and development of these structures, and an (...) analysis of those components of the moral system that are uniquely human and uniquely moral. In this paper we present the theoretical motivations for adopting LA in the study of moral cognition: (a) the distinction between competence and performance, (b) poverty of stimulus considerations, and (c) adopting the computational level as the proper level of analysis for the empirical study of moral judgment. With these motivations in hand, we review recent empirical findings that have been inspired by LA and which provide evidence for at least two predictions of LA: (a) the computational processes responsible for folk-moral judgment operate over structured representations of actions and events, as well as coding for features of agency and outcomes; and (b) folk-moral judgments are the output of a dedicated moral faculty and are largely immune to the effects of context. In addition, we highlight the complexity of the interfaces between the moral faculty and other cognitive systems external to it (e.g., number systems). We conclude by reviewing the potential utility of the theoretical and empirical tools of LA for future research in moral psychology. (shrink)
